We hereby kindly invite you to attend the final Frontiers of Forensic Science (FFS) of the academic year 2021-2022.
This session will be unique as we have never focused on a single case and the role of forensic science from the defense perspective.
The title ‘Death in Paradise’ refers to an infamous case of a double murder in 2005 on the Caribbean island of Bonaire.
In this session, Carry and Geert-Jan Knoops of Knoops’ Advocaten will explain their efforts including the use of forensic science to overturn a double wrongful conviction.
They are assisted by Gerard de Haas and Jan Rooijakker who were involved in the investigation on behalf of the Public Prosecution Office and the Dutch Police.
This case illustrates the importance of convincing and reliable evidence in criminal law proceedings and the access of the defense council to forensic investigative methods.

Op maandag 11 april vond de boekpresentatie van het boek Operatie Raaf plaats bij Uitgeverij Balans, alwaar de heer Julio Poch één van de eerste exemplaren overhandigd kreeg.
Vanaf heden is de uiterst spannende reconstructie van de zaak-Poch verkrijgbaar in de boekhandel. Opened since 28 January 2016, the trial of the Prosecutor of the International Criminal Court against Mr. Charles Blé Goudé ended on 31 March 2021 with the confirmation of the 15 January 2019 decision, which acquitted the accused.
On the basis of Article 85 (3) of the Rome Statute, which provides that in exceptional circumstances, where the Court finds that a grave and manifest miscarriage of justice has occurred, the judges may, at their discretion, award compensation to an acquitted person after his detention, Mr. Charles Blé Goudé, after consultation with his lawyers, filed a request for compensation before the International Criminal Court (“ICC”) on 09 September 2021.
Mr. Charles Blé Goudé noted the numerous failures of the Office of the Prosecutor that have violated his fundamental rights. To this day, he continues to suffer the consequences of the violation of his human rights since, despite his acquittal, Mr. Charles Blé Goudé is forced to live outside his country as a stateless person.
In filing this compensation request before the ICC, Mr. Charles Blé Goudé knows very well that no financial compensation will ever be able to adequately compensate him for the heavy moral and psychological damage he suffered, as well as the years he spent unjustly in detention.
However, Mr. Charles Blé Goudé hopes that his case can serve as an example to call the Office of the Prosecutor of the ICC to greater responsibility; this linchpin of international justice, in the exercise of its mission, should not pursue pre-constructed cases, which are unconvincing, and not based on evidence.
Finally, Mr. Charles Blé Goudé promises that if the Court grants his request, he will use part of this compensation to help the victims of the post-election crisis in his country.

Persbericht namens brandweerman: verbod tot ontslag in verband met lidmaatschap Hells Angels
De uitspraak van de Centrale Raad van Beroep van heden in de zaak van de Amsterdamse brandweerman, waarbij de Centrale Raad oordeelde dat deze niet mag worden ontslagen vanwege het lidmaatschap van de Hells Angels, is niet alleen van belang voor het herstel van het dienstverband tussen de Veiligheidsregio Amsterdam-Amstelland en de brandweerman (hij mag niet worden ontslagen) maar ook voor alle andere personen die lid zijn van de Hells Angels of een andere OMG en waarvan de werkgever oordeelt dat dit lidmaatschap ongewenst zou zijn. De Centrale Raad oordeelt dat dit laatste op zich niet voldoende is voor een ontslag en vereist een op het specifieke geval toegesneden afweging en het bestaan van concrete gedragingen van de zijde van de ambtenaar die in verband staan met criminele activiteiten.
Tevens is deze uitspraak van belang omdat de Centrale Raad in rechtsoverweging 3.6 van de uitspraak overweegt dat “niet alle OMG’s over één kam kunnen worden geschoren en dat ook niet kan worden gezegd dat alle outlawbikers, charters of clubs crimineel actief zijn”. Dat wil zeggen dat, zolang van een onherroepelijk verband van een dergelijke OMG geen sprake is, de enkele constatering van het lidmaatschap zonder deze concrete gedragingen niet tot ontslag kunnen leiden.
Voorts is van belang dat uit deze uitspraak in rechtsoverweging 3.6 kan worden afgeleid dat zolang de verbodenverklaring van de betreffende OMG nog niet onherroepelijk is geworden, het de betreffende persoon (in casu de brandweerman) vrijstaat om zijn activiteiten in naam van Hells Angels voort te zetten en in het openbaar de colors van de Hells Angels te dragen. De Centrale Raad acht hierbij van belang dat in een dergelijke situatie geen beperkingen in de vrijheid van vereniging en vergadering, als zijnde belangrijke grondrechten, toelaatbaar zijn.
